Under the Maharashtra Co-operative Societies framework, the statutory heads of billing are closed and exhaustive (Model Bye-Law No. 67): 1. Water Charges, 2. Election Fund, 3. Sinking Fund, 4. Repairs & Maintenance Fund, 5. Property Taxes & Municipal Cesses, 6. Building Insurance Premium, 7. Parking Charges, 8. Education & Training Fund, 9. Service Charges, 10. Non-Occupancy Charges, and 11. Late Interest on Arrears. Any charge outside these 11 statutory heads falls into two categories: (1) Strictly Illegal Charges: Compulsory Festival / Cultural / Pooja Funds (barred under Model Bye-Law 145) or arbitrary Move-in / Move-out shifting fees; and (2) Unsanctioned Ghost Charges: Charges like 'Water Tax', 'Development Levy', 'Building Improvement Fund', 'Asset Replacement Surcharge', or generic 'Miscellaneous Charges'. Under MCS Act Section 72 and Bye-Law 142, Managing Committees have no authority to invent new charge heads or levy arbitrary amounts on their own. Any such charge is statutorily invalid unless backed by an explicit General Body (AGM/SGM) resolution date and formula.
